These Terms and Conditions (“Terms”) govern your access to and use of the Bookezy platform, website, software, and related services (collectively, the “Service”), operated by Bookezy (“Bookezy,” “we,” “our,” or “us”).
By creating an account, subscribing, or using Bookezy in any way, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility & Account Responsibility
You must be at least 18 years old and capable of forming a legally binding contract to use Bookezy.
You are responsible for:
Providing accurate and complete account information
Maintaining the confidentiality of your login credentials
All activity occurring under your account
Bookezy is not responsible for unauthorized access caused by your failure to secure your account.
2. Description of Service
Bookezy is a subscription-based online scheduling and business management platform designed for barbers and appointment-based professionals. Features may include:
Online booking
Client management
Automated SMS & email notifications
Review requests
Rebooking reminders
Business analytics and tools
Features may change, improve, or be discontinued at any time.
3. Subscription, Billing & Payments
3.1 Billing
Bookezy is billed on a monthly recurring subscription
Payments are processed securely via Stripe
You authorize Bookezy to charge your payment method automatically each billing cycle
3.2 Failed Payments
If payment fails:
Your account may be temporarily suspended
Continued failure may result in termination
3.3 Refunds
All payments are non-refundable, including partial months, unless otherwise required by law or explicitly stated in writing by Bookezy.
4. SMS (A2P 10DLC) & Email (SMTP) Compliance
4.1 SMS Messaging Consent
By using Bookezy’s SMS features, you confirm that:
You have obtained explicit opt-in consent from your clients to receive SMS messages
Messages are related only to legitimate business purposes (appointments, reminders, rebooking, reviews)
You may not:
Send unsolicited, deceptive, or spam messages
Use purchased or scraped phone lists
Send messages unrelated to your services
Clients must be able to opt out at any time by replying STOP.
4.2 A2P Compliance
You agree to comply with all:
Carrier rules (US/Canada)
A2P 10DLC regulations
Messaging laws including TCPA, CASL, and similar regulations
Bookezy reserves the right to suspend or terminate messaging access if violations are detected.
4.3 Email (SMTP) Compliance
You agree that:
All email recipients have explicitly opted in
Emails include proper sender identification
Emails include a visible and functional unsubscribe mechanism
You comply with CAN-SPAM, CASL, and applicable email laws
Bookezy does not guarantee deliverability and is not responsible for spam filtering or blacklisting caused by your actions.
5. Client Data & Privacy Responsibility
5.1 Your Data Responsibilities
You retain ownership of all client data you upload or collect using Bookezy.
You are solely responsible for:
Lawfully collecting client data
Obtaining consent for communication
Ensuring compliance with privacy laws (PIPEDA, GDPR, CCPA, etc.)
5.2 Bookezy’s Role
Bookezy acts as a data processor, not the data owner. We:
Store data securely using industry-standard safeguards
Do not sell client data
Only access data as necessary to provide the Service
6. Prohibited Uses
You may not use Bookezy to:
Violate laws or regulations
Send spam, scams, or misleading messages
Harass, abuse, or impersonate others
Upload malware or attempt unauthorized access
Resell or white-label Bookezy without written consent
Violation may result in immediate suspension or termination.
7. Service Availability & Limitations
Bookezy strives for reliability but does not guarantee:
Uninterrupted uptime
Error-free performance
Increased revenue or business success
Temporary downtime may occur due to maintenance, third-party outages, or force majeure events.
8. Third-Party Services
Bookezy integrates with third-party services (e.g., Stripe, SMS carriers, email providers). We are not responsible for:
Their outages or errors
Policy changes
Service interruptions
Your use of third-party services is subject to their respective terms.
9. Intellectual Property
All software, branding, designs, logos, and content owned by Bookezy are protected by intellectual property laws.
You are granted a limited, non-transferable, revocable license to use the Service while subscribed.
10. Termination
Bookezy may suspend or terminate your account if:
You violate these Terms
You misuse SMS/email features
Required by law or carriers
Payment obligations are not met
You may cancel your subscription at any time. Access will continue until the end of the billing cycle.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
Bookezy disclaims all warranties, including:
Merchantability
Fitness for a particular purpose
Non-infringement
12. Limitation of Liability
To the maximum extent permitted by law, Bookezy shall not be liable for:
Lost revenue
Lost data
Business interruption
Indirect or consequential damages
Total liability shall not exceed the amount paid by you in the last 3 months.
13. Indemnification
You agree to indemnify and hold harmless Bookezy from any claims arising from:
Your use of the Service
Violations of laws
Client communication violations
Data misuse
14. Governing Law
